Welcome to Caps Delivery (“Caps”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the Caps website, mobile application, and related services (collectively, the “Platform”).
By accessing or using the Platform, you agree to be bound by these Terms and enter into a legally binding agreement with Caps Delivery Private Limited and/or its affiliates. If you do not agree with these Terms, you must not use the Platform.
Your use of the Platform is at your own risk, including the possibility of exposure to content that may be inaccurate, objectionable, or inappropriate.
Acceptance of these Terms occurs when you:

- Access or use any part of the Platform.
II. Definitions
Customer / You
“You” or “Customer” refers to any individual or entity accessing or using the Platform to browse, place orders, post content, or otherwise interact with the Services.
Content
Includes reviews, ratings, images, menus, descriptions, text, audio, video, location data, and all other information available on the Platform.
- Customer Content: Content submitted by you.
- Caps Content: Content created or owned by Caps.
- Third-Party Content: Content provided by restaurant partners, delivery partners, or other third parties.
Restaurant Partner
Restaurants, cloud kitchens, or food businesses listed on the Caps Platform.
III. Eligibility
You must be at least 18 years of age to use the Platform.
You represent that you:
- Are legally competent to enter into these Terms
- Will comply with all applicable Indian laws and regulations
- Will use the Platform only for lawful purposes
IV. Changes to Terms
Caps reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform. Continued use after changes constitutes acceptance of the revised Terms.
V. Platform & Services
Caps provides a technology platform that enables Customers to:
- Browse restaurant listings and menus
- Place food orders
- Track deliveries
- Receive customer support
Caps does not prepare food and does not guarantee food quality, hygiene, or pricing. These remain the responsibility of the Restaurant Partner.
Caps may suspend, modify, or discontinue any feature or service at its discretion without prior notice.
VI. Customer Accounts
- Certain features require account registration
- You are responsible for maintaining confidentiality of your login credentials
- You must provide accurate and up-to-date information
- You are responsible for all activity under your account
- Caps may suspend or terminate accounts for violations or misuse
VII. Orders, Delivery & Payments
- Orders placed on the Platform constitute authorization for Caps to transmit the order to the Restaurant Partner
- Delivery may be fulfilled by the Restaurant Partner or third-party delivery partners
- Delivery timelines are estimated only
- Delivery fees, surge fees, and taxes may apply and vary
- Caps acts only as an intermediary, not a seller or logistics provider
VIII. Pricing & Availability
- Prices and menu items are provided by Restaurant Partners
- Actual prices may vary at the time of preparation
- Caps is not responsible for price discrepancies, portion size, or availability
IX. Cancellation & Refunds
- Cancellation and refund eligibility depends on order status and Restaurant Partner policies
- Refunds, if applicable, will be processed to the original payment method or as Caps credits
- No refunds will be issued for incorrect addresses, unreachability, or customer-initiated delays
XII. Third-Party Content & Links
Caps is not responsible for:
- Accuracy or legality of third-party content
- External websites or services linked through the Platform
- Actions or omissions of Restaurant Partners or Delivery Partners
XIII. Disclaimers
The Platform is provided “as is” and “as available.”
Caps does not warrant:
- Food quality, hygiene, or dietary suitability
- Continuous availability or error-free operation
- Accuracy of menus, ratings, or delivery estimates
XIV. Limitation of Liability
To the maximum extent permitted by law, Caps shall not be liable for:
- Food quality or preparation issues
- Delivery delays or failures
- Indirect, incidental, or consequential damages
- Loss of data, profits, or goodwill
Caps’ total liability shall not exceed the amount paid by you for the specific order giving rise to the claim.
XV. Indemnification
You agree to indemnify and hold harmless Caps from claims arising from:
- Your use of the Platform
- Your violation of these Terms
- Your submitted content
- Your interactions with Restaurant or Delivery Partners
XVI. Termination
Caps may suspend or terminate access:
- For violation of Terms
- For suspected fraud or abuse
- For prolonged inactivity
You may delete your account at any time via the Platform or customer support.
XVII. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India.
Courts at Hyderabad, Telangana, shall have exclusive jurisdiction.
