These Terms are to be read together with the Caps Delivery Terms of Service (“Terms of Service”), which are incorporated herein by reference. In the event of any inconsistency, the Terms of Service shall prevail.
By accessing or using the Platform, or by clicking “I Agree” (or similar), you confirm that you have read, understood, and agreed to be bound by these Terms.
ABOUT CAPS DELIVERY
Caps Delivery is operated by Caps Technology Pvt. Ltd. (“Caps”, “we”, “our”, or “us”). Caps operates a technology-enabled marketplace platform that connects customers with independent restaurant partners and delivery partners. Caps acts solely as an intermediary and does not prepare food, operate restaurants, or provide delivery services directly, unless expressly stated otherwise.
All restaurant partners and delivery partners operate independently and are solely responsible for their respective services and compliance with applicable laws.
ELIGIBILITY
Access to and use of the Platform is strictly prohibited for individuals below the age of 16 years. Individuals between 16 and 18 years of age may use the Platform only with the consent and supervision of a parent or legal guardian. By using the Platform, you represent that you have the legal capacity to enter into binding terms under applicable law.
USER ACCOUNTS
Certain features of the Platform may require you to create and maintain an account. You are responsible for providing accurate and complete information and for maintaining the confidentiality of your login credentials. You are solely responsible for all activities conducted through your account.
Caps reserves the right to suspend or terminate your account, restrict access, or forfeit unused credits or promotional benefits in accordance with the Terms of Service, including in cases of misuse, inaccurate information, suspected fraud, or violation of these Terms.
USE OF THE PLATFORM
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You shall not misuse the Platform, attempt unauthorized access, impersonate any person, interfere with security features, submit false or abusive content, or engage in any activity that may harm Caps, other users, or third parties.
Caps may, at its discretion and without prior notice, restrict or block access to the Platform for violations of these Terms.
ORDERS, PAYMENTS & DELIVERY
Orders placed through the Platform are transmitted to independent restaurant partners. Prices, menus, availability, preparation, and food quality are determined solely by the restaurant partners. Caps does not guarantee menu accuracy, pricing, or availability.
Delivery times displayed on the Platform are estimates only and are not guaranteed. Deliveries may be fulfilled by restaurant partners or independent third-party delivery partners. Caps is not responsible for delays caused by traffic, weather, restaurant operations, customer unavailability, or incorrect delivery details.
All payment processing, charges, refunds, credits, and invoicing are governed by the Terms of Service and applicable restaurant partner policies.
CANCELLATIONS & REFUNDS
Cancellation and refund eligibility depends on order status and restaurant partner policies. Once an order has been accepted or food preparation has commenced, cancellations or refunds may not be permitted. Any approved refunds or credits shall be processed in accordance with the Terms of Service.
FOOD QUALITY & SAFETY
Caps does not prepare or handle food and does not guarantee food quality, hygiene, safety, ingredients, allergens, or dietary suitability. All such responsibilities rest solely with the restaurant partners. Any reliance on menu descriptions, ingredient information, or dietary disclosures is at your own risk.
PROMOTIONS & CREDITS
Promotions, coupons, and credits offered on the Platform are subject to specific terms and may be modified, suspended, or withdrawn at any time. Promotions are non-transferable and cannot be exchanged for cash. Misuse may result in suspension or termination of your account.
CONTENT & INTELLECTUAL PROPERTY
All intellectual property rights in the Platform, including trademarks, logos, content, and software, are owned by Caps or its licensors. User-generated content, including reviews and feedback, must be genuine and lawful and shall be governed by the content and license provisions set out in the Terms of Service.
THIRD-PARTY CONTENT
The Platform may include content or links provided by third parties. Caps does not control, endorse, or assume responsibility for any third-party content, products, or services, and shall not be liable for any loss or damage arising from your interactions with third parties.
DISCLAIMER & LIABILITY
The Platform and Services are provided on an “as is” and “as available” basis. Caps’ disclaimers, limitation of liability, indemnity obligations, dispute resolution, and termination rights are governed exclusively by the Terms of Service.
GOVERNING LAW & CHANGES
These Terms shall be governed by and construed in accordance with the laws of India, with courts at Hyderabad, Telangana having jurisdiction, subject to the dispute resolution provisions in the Terms of Service. Caps may modify these Terms from time to time, and continued use of the Platform constitutes acceptance of the updated Terms.
